These Terms of Service (the "Terms") govern your access to and use of the website at alignovastore.com, the Alignova online store, and any related services (collectively, the "Services") provided by Alignova ("Alignova," "we," "us," "our"). By accessing the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to place an order with Alignova. By placing an order, you represent that you meet this requirement and that the information you provide is accurate, current, and complete.
2. Accounts
You are responsible for safeguarding the credentials associated with your Alignova account and for all activity that occurs under those credentials. Notify Alignova at support@alignovastore.com immediately if you suspect unauthorized access. Alignova may suspend or terminate accounts that violate these Terms or that are used in a manner that disrupts the Services.
3. Orders, pricing, and acceptance
All orders placed through the Services are offers to purchase. Alignova reserves the right to accept or decline any order at its discretion, including in cases of suspected fraud, pricing errors, inventory unavailability, or shipping restrictions. Prices and product availability are subject to change without notice. In the event of an obvious pricing error, Alignova may cancel the affected order and refund any amount charged.
4. Promotions, discounts, and bundles
Alignova may offer automatic discounts, volume discounts, "Buy X Get Y Free" promotions, and other limited-time offers. Discounts apply only to qualifying items, may not be combined unless expressly stated, and may be withdrawn at any time. Discount values displayed in the bundle interface are confirmed at checkout by Alignova's automatic discount rules; the checkout total is the authoritative price.
5. Payment
Payments are processed by Shopify Payments and other PCI-DSS compliant providers. By submitting payment information, you authorize Alignova or its processors to charge the amount shown at checkout to your chosen payment method. You are responsible for any sales, use, or value-added taxes assessed on your order, where not collected at checkout.
6. Shipping and risk of loss
Shipping options, transit times, and applicable fees are presented at checkout. Title and risk of loss for products purchased from Alignova pass to you upon delivery by the carrier to the shipping address you provide. Refer to the Alignova Shipping Policy for additional terms.
7. Returns and refunds
Returns and refunds are governed by the Alignova Refund Policy. To initiate a return, contact support@alignovastore.com within the eligibility window. Products returned outside the eligibility window or in non-original condition may be refused or subject to a restocking fee.
8. Intended use and medical disclaimer
Alignova products are designed as wellness aids — including posture-supportive garments and related accessories — and are not medical devices. The Services and any educational content distributed by Alignova do not constitute medical advice, diagnosis, or treatment. Consult a licensed healthcare professional before beginning use, particularly if you are pregnant, recovering from surgery, have a spinal condition, or experience persistent pain. Discontinue use and seek medical attention if you experience numbness, tingling, sharp pain, or any other adverse symptom.
9. Intellectual property
The Services, including text, graphics, photography, illustrations, logos, product designs, software, and the "Alignova" name and trademarks, are owned by Alignova or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Services without prior written permission from Alignova, except for personal, non-commercial browsing and purchasing activity.
10. User-submitted content
If you submit reviews, photographs, ratings, comments, or other content to the Services, you grant Alignova a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with the Services and Alignova's marketing. You represent that you own or have the necessary rights to submit the content and that it does not infringe any third-party right.
11. Acceptable use
You agree not to use the Services to: (a) violate any law or regulation; (b) infringe the intellectual-property, privacy, or other rights of any party; (c) introduce malware or interfere with the operation of the Services; (d) reverse-engineer, scrape, or extract data from the Services except as expressly permitted; (e) impersonate any person or entity; or (f) submit false, misleading, or fraudulent information.
12. Third-party services and links
The Services may contain links to third-party websites or integrations with third-party providers (payment, shipping, social media, analytics). Alignova is not responsible for the content, policies, or practices of any third party.
13. Disclaimer of warranties
To the maximum extent permitted by law, the Services and all products are provided "as is" and "as available." Alignova disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or trade usage. Alignova does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
14. Limitation of liability
To the maximum extent permitted by law, Alignova and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Alignova's aggregate liability for any claim arising from the Services or any product shall not exceed the greater of (a) the amount you paid Alignova for the product giving rise to the claim or (b) one hundred United States dollars (USD 100).
15. Indemnification
You agree to indemnify, defend, and hold harmless Alignova from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any third-party right.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Where applicable consumer-protection law affords you mandatory rights in your jurisdiction, those rights are unaffected.
17. Changes to these Terms
Alignova may modify these Terms from time to time. The "Effective date" reflects the most recent revision. Continued use of the Services after a change constitutes acceptance of the revised Terms.
